Justification:
Justification for exceptional negotiated procedure, in line with Annex I to FR (point 11.1 (c), for provision of SARS-CoV-2 PCR and Rapid Antigen Testing for staff in the Headquarters and in the training centres of Frontex in Poland (Koszalin and Ketrzyn):Frontex wants to ensure the business continuity and high performance of the Agency respecting the safety and well-being of its all Frontex personnel in the Headquarters and in the training centers in Poland, in Koszalin and Ketrzyn, in line with the Agency’s duty of care principle.The massive outbreak of Covid-19 cases in one of the training centres created an unexpected and imminent crisis situation overwhelming the centre’s capacities (around 40 % out of 150 staff tested positively with Covid-19 in Koszalin training centre). In addition to the above, the overall deteriorating pandemic situation in PL and also in other EU Member States creates an unprecedented and unforeseeable situation and an extreme emergency, which are obviously not attributable to the Agency.The critical circumstances do not allow the following of the relevant deadlines of the standard procurement procedures.Currently, health and safety and well-being of staff in the two training facilities and in the Headquarters is at stake and Frontex should take immediate measures in view of its duty of care and prevention of further spreading of Covid-19.In line with the above, Frontex decided to procure without a delay a specific set of testing for its staff (SARS-CoV-2 PCR and Rapid Antigen Testing).SARS-CoV-2 PCR and Rapid Antigen Testing forms part of such preventive measures, which were included in Frontex’ risk management plan for a safe work environment during the Covid-19 pandemic.The necessary three conditions of the exceptional negotiated procedure are met:— there is an unforeseeable event,— it is not attributable to the contracting authority and— it is impossible to follow an ordinary procedure.The use of the exceptional negotiated procedure will be used only ‘as strictly necessary’, therefore, in parallel the Authority will start preparing the tender documentation for a full scope of medical service related to Covid to put in publication under an open procurement procedure.
